Q.01

Can I sell a junk car without a title in California?

Sometimes. It depends on the paperwork you can show, and every buyer sets their own rules, so ask before a pickup is booked. A registration card in your name with a matching photo ID covers some sales. Others need the title, or a duplicate from the DMV.

The title proves the car is yours to sell. Without it, a buyer takes the risk that the car is stolen or carries a lien, so they look for other proof. Registration in your name, a bill of sale from when you bought the car, and a VIN that matches the paperwork all help. A car with no paperwork at all is the hard case, and an honest buyer will tell you so on the call.

Q.02

How do I get a replacement title in California?

File an Application for Duplicate or Paperless Title, form REG 227, with the DMV. You need the vehicle's details and proof of identity, and a fee applies. If a lender is listed on the title, they may need to sign too. Check dmv.ca.gov for the current fee and steps.

A duplicate title is mailed, so it takes some time to arrive. If the car needs to be gone sooner, ask the buyer whether a signed REG 227 in hand is enough to go ahead; some accept it. For a junk car the duplicate fee is often worth paying, because a clean title opens up more buyers and can raise the offer.

Q.03

What if the title is in someone else's name?

The person named on the title has to sign it over, or you need paperwork showing you have the right to sell. If you bought the car and never transferred it, the seller's signature on the old title plus your bill of sale may be enough. Ask on the call.

This comes up a lot with cars bought from a friend or from a listing years ago and never registered. The old title, signed by the previous owner, is the document that matters. If it was never signed, try to reach the previous owner. If you cannot, the DMV can tell you what it will accept instead, but expect that route to take longer.

Q.04

How do I sell a car that belonged to someone who passed away?

In California the heir or the estate's representative signs for the owner who died, using DMV paperwork that depends on whether the estate goes through probate. Tell the buyer about the situation before a pickup, so you know which papers they need to see.

When there is no probate, the DMV's Affidavit for Transfer Without Probate (REG 5) is the usual form. With probate, the court-appointed representative signs. Have the death certificate and the title or registration available. In a valley with many retirees these sales come up often, and buyers who handle them know the paperwork.

Q.05

Can I sell a car with only the registration?

Some buyers accept a current registration card in your name with a matching photo ID for an older junk car, and many do not. The older and cheaper the car, the more likely registration alone will do. Ask before the pickup is set.

A registration that expired years ago carries less weight than a current card. If yours lapsed long ago, say so, and the buyer will tell you whether it is enough. Have the card and your ID ready, and read the VIN off the dash so it can be matched against the registration.

Q.06

What does a buyer check on a car without a title?

A buyer checks that the VIN on the car matches your paperwork and that the car is not reported stolen or under a lien. The VIN is on the dash at the base of the windshield and on a sticker in the driver's door jamb.

Some buyers run the VIN through a vehicle history service before the pickup. If an old loan left a lien on record, the lender has to release it, even when the loan was paid off years ago and the paperwork was never sent. Clearing that first saves a wasted trip for everyone.

Q.07

Does a missing title lower the offer?

It can. A car without its title has fewer buyers and takes more paperwork, so the offer may be lower than for the same car with a title in hand. On anything newer than a basic scrap car, getting a duplicate first often pays for itself.

For a car worth only its weight in steel, the difference is usually small. For a newer wreck with good parts, the title matters more. Ask for both numbers on the call: what the car brings now, and what it would bring with a duplicate title.

Q.08

Does the buyer handle the DMV paperwork?

The buyer handles their side of the transfer, but filing the release of liability (REG 138) is your job as the seller. File it within 5 days of the sale, online at dmv.ca.gov, so tickets and tolls on that car stop reaching you.

When a car sells without its original title, keep copies of whatever you signed: the bill of sale, the REG 227 if you filed one, and a photo of the VIN. Those papers show the date the car left your hands if a notice ever arrives later.
